What is Complying Development?
Complying development offers a streamlined approval process for straightforward residential, commercial, and industrial projects. These types of developments often involve more extensive building work than exempt developments but can still avoid the full Development Application (DA) process. If your project meets specific standards, it can be approved by your local council or a registered certifier.
The Codes SEPP (State Environmental Planning Policy) outlines what qualifies for complying development. This covers residential, commercial, and industrial projects, as well as subdivisions (both strata and Torrens), fire safety installations, and demolition work. For residential developments, common examples include:
Building new homes up to two storeys
Renovating existing homes
Constructing dual occupancies, terraces, or manor houses
Installing new swimming pools
Each type of development within the Codes SEPP has its own set of rules and standards that must be followed. These vary depending on the type and location of your project, such as specific requirements for developments in rural council areas.
How is Complying Development Assessed?
To apply for a Complying Development Certificate (CDC), you’ll need to submit your plans to a certifying authority, which could be your local council or a registered certifier.
It’s a good idea to consult a certifier early in the planning stage, as they can guide you in ensuring your project meets all necessary standards. Once your CDC is approved, you must appoint a Principal Certifier (PC) before starting construction. The PC will inspect the works to ensure everything complies with the CDC and relevant building codes. You can appoint the same certifier who approved the CDC or choose a different one for this role.
